TERMS AND CONDITIONS

Olé Languages BCN S.L (“the school”) organizes Spanish language courses in Spain. When the school is represented by agents, travel agencies or other parties (“agents”) the company is not liable for any damage or compensation resulting from any agreement or information exchange between the client and these agents. Instead, recourse should be sought with these agents directly by clients in case of disagreement or damages.


1.- This Agreement

1.1 This agreement is legally binding once the school has received a completed enrolment form from the student, whether on-line or in writing. If the booking is made by telephone, the agreement is legally binding once the booking details have been taken by the school and once a payment (advanced or full payment) has been received by the school.

1.2 The law of Spain shall apply to this agreement.


2.- School Liability

2.1 The school accepts no responsibility whatsoever for student actions. The school assumes no responsibility for accidents, theft or injuries during the client’s stay with the school.

2.2 The school cannot be held responsible for actions or negligence of the service providers concerned nor for the information supplied by them. Service providers are the transport company, accommodation agency, travel company or other service provider with whom the student reaches an agreement with or without mediation of the school.

2.3 The school cannot take responsibility for disruptions to courses resulting from forces out of our control (such as natural disasters, strikes, civil disorders etc.). Lessons lost as a result of the above causes will not be recovered or refunded.

2.4 Complaints about the execution of the agreement, the course, accommodation and transfer service, should be reported immediately to the school’s secretary. If the student does not contact the school within reasonable time, the school cannot be held responsible.

2.5 The school is not responsible for printing errors that may appear or for errors in publications by third parties of the school. Although every effort has been made to ensure that the information contained in our literature and websites is accurate, the school does not accept responsibility on printing/translating errors or omissions.


3.-Student Conduct, Liability and Responsibility

3.1 All students are required to attend classes, notify the school in case of absence and respect other students, teachers and staff. The illegal use of drugs, alcohol abuse or inconsiderate or offensive behaviour towards others is considered unacceptable. The school reserves the right to cancel a course and/or remove the student from the accommodation without refund in circumstances where the student is found to be in breach of the school code of conduct.

3.2 Students are not covered for any illnesses, accidents, or loss of personal property (neither in the accommodation nor inside or outside of the classroom).

3.3 The student is responsible for having the correct documents and insurance policy and medical policy regarding their stay abroad.

3.4 The student is obliged to inform the school of their arrival details as requested by the school. If the student sends incomplete information, or sends the information too late, the school cannot guarantee to properly arrange the airport transfer or the pickup of the accommodation key.


4.-Payment

4.1 The student has to make a minimum advanced payment of 150 € at the time of the booking and this amount will be deducted from the total cost.

4.2 The school reserves the right to cancel the student’s reservation for non-payment of the 150 euros.

4.3 The total cost consist of the cost of the course, accommodation and any other extra services or fees.

4.4 Unless mentioned or agreed otherwise, the student is obliged to pay the remainder of the total cost on the first day of course.

4.5 The client will have no access to class before payment in full has been received.

4.6 Students who require the school to issue official documentation in order to support a student visa application must pay their total cost before the school will issue such documentation. Students that require documentation to be sent via courier or express mail will be charged the cost of this service.

4.7 The school is not responsible for students’ bank charges. In the event that the bank charges the school a commission, this cost will be added to the students’ total cost upon their arrival

4.8 When the student makes a payment in a currency other than Euros, a surcharge might apply to cover the cost for currency exchange. In such cases the cost will be paid by the student.


5.-Minimum Age and Documentation

5.1 The minimum age for attending Olé Languages is 18 years. For certain courses and under certain circumstances exceptions are made. In case of a booking by a minor, an authorisation letter has to be completed and signed by the parent or legal guardian.

5.2 Students are requiered to show to school official documents in order to be accepted. National identity card (or passport) for european students and passport for non-European students.


6.-Late Arrival or Absence

6.1 When the student starts the course later than the specified starting dates, being justifiable or not (including illness, personal reasons etc.), there will be neither refund nor compensation with a free extension of the course.

6.2 Classes that are missed due to student absence cannot be recovered.

6.3 In case of a lack of course attendance the following rules apply:

        - The school is entitled to deny the student certificate. The school will only provide the school certificate when the student has attended at least 80% of the classes.

        - The school is entitled to re-assign the student to a new group that suits to his/her real level.


7.-Language Course

7.1 The school may change course structure and timetables when necessary.

7.2 Unless otherwise agreed, the first day of the course is on a Monday and the last day on a Friday.

7.3 On public holidays there will be no classes and such days will not be recuperated or refunded. One-to-one classes that fall in public holidays will be rescheduled.

7.4 The minimum number of participants to confirm a group is 3 and the maximum 9. If requested, a class of 2 can be formed for the same price but with fewer hours per week.

7.5 The school reserves the right not to open a class if it does not arrive at the minimum number of students.

7.6 Depending on the student numbers and the classrooms availability the school retains the right to determine the timetable of the lessons.

7.7 One lesson is equivalent to 52,5 minutes for the Intensive Courses. One lesson is equivalent to 60 minutes for the Evening and Semi-Intensive courses.

7.8 Passing a level will only be determined by the teachers and/or coordinator’s criteria.


8.-Accommodation

8.1 Unless otherwise agreed, the accommodation can only be booked per complete week, the day of arrival and departure is from Saturday to Saturday. Arrival at the accommodation after 23:00 may not be possible and could have and extra charge.

8.2 Extra nights can be booked at additional cost and are subject to availability.

8.3 The student is obliged to follow the accommodation rules provided by the school and/or the landlord/landlady.

8.4 Students who book accommodation in an apartment will be required to pay a deposit of 100 euros on arrival. Any loss or damage that is attributed to the student will be deducted from this deposit before the balance is returned.


9.-Aiport pick-up Service

9.1 The school airport pick-up service operates from Barcelona “El Prat” airport to the student’s accommodation. To book the service payment in full is required. The student has to provide the school with the flight number and arrival time at least 10 days before the student is due to arrive.

9.2 The school will not be responsible for airport pick-ups or refunds in the event of delay or changes in flight information where sufficient notification is not provided.


10.-Activities and Excursions

10.1 Information about activities and excursions offered by the school should only be used as a guide and not as an accurate list of events. Some activities may not run or may be substituted by other activities.


11.-Changes made to Bookings by the Student

11.1 The following rules apply for modifications made to bookings by the student before the start date:

        - The student must notify the school in writing by e-mail, fax or letter. Notifications not received via one of these methods will not be accepted.

        - Request for modifications received 15 days or more before the start date are possible and the school will not charge any fee but the modifications are subject to availability.

        - Request for modifications received from 14 to 0 days before the start date are generally not possible In case of it being possible, an extra fee of 30 euros will be charged. These modifications are subject to availability.

11.2 The following rules apply for modifications made to bookings by the student once the course has started:

        - The student must notify the school in writing by e-mail, fax or letter at least 7 days before these changes are applied. Notifications not received via one of these methods will not be accepted.

        - Request for modifications received once the course has started are generally not possible. In case of it being possible, an extra fee of 30 euros will be charged. These modifications are subject to availability.

11.3 All modifications are only valid when confirmed by the school.

11.4 A course reservation is assigned to an individual basis and therefore it cannot be re-assigned or transferred to another student.

11.5 Students who have been issued with the school’s official documents for the purpose of applying for a student visa cannot change the end date of their course and cannot convert the group classes into private lessons.


12-.Cancellations by the Student.

12.1 All students who wish to cancel their course and accommodation must notify the school in writing by e-mail, fax or letter. Notifications not received via one of these methods will not be accepted. The date of cancellation is regarded to be the date on which the written notice was received by the school.

12.2 The student can cancel the booking 45 days or more before the course start date and the school will refund the advanced payment.

12.3 In the case of cancellation 44 to 20 days before the course start date the school will refund the advanced payment except 75 euros.

12.4 In the case of cancellation 19 to 0 days before the course start date the school will refund the advanced payment except 150 euros.

12.5 Cancellations are not possible once the course has started. No refund shall be given after the day the course is due to start.

12.6 Students who have been issued the school’s official documents for the purpose of applying for a visa cannot cancel their course unless the visa application fails and a copy of the official rejection document from the embassy or consulate is provided to the school. In that case:

        - If the school receives the rejection letter at least 15 days before the start date the school will refund the total amount paid minus an administrative fee of 200 euros.

        - If the school receives the rejection letter less than 15 days in advanced the school will refund the total amount paid minus an administrative fee of 200 euros and minus 2 weeks of course and 2 weeks of accommodation if reserved.

        - No refunds will be given to students who do not provide the official rejection letter from the embassy or consulate.

        - Where a refund is given, any bank charges related to transfers, exchange rate movements and postal/express mail/courier costs will be deducted from the refundable amount due.
